Dr. Simon Gurisch

Simon Gurisch is a philosopher. He studied philosophy, sociology, and art history at Goethe University Frankfurt. In 2022, he received his PhD from the Department of Philosophy at Goethe University with a dissertation entitled: Die Verfassung des Lebens. Die politische Form der Vergesellschaftung durch Individuation bei J. Habermas und G.W.F. Hegel.

His research focuses on political philosophy and philosophy of law, with particular emphasis on early Critical Theory, Historical Materialism, and German Idealism.

He is currently a member of the project A06 „The normative foundations of property: Digital property“.

Research Project

His project investigates how the legal form of property transforms under the conditions of digital capitalism, and how this transformation relates to broader shifts in the political and normative function of ownership. The starting point of the study is the assumption that ownership in the digital age is no longer primarily rooted in tangible objects, but in legal coding practices that assign exclusive control over immaterial goods - data, algorithms, digital infrastructures. Drawing on Critical Theory, especially the work of Franz Neumann, as well as Hegel’s theory of property and its reinterpretation in contemporary philosophy of law, the project explores the historical and systematic relationship between the legal form of property and the material relations it regulates. The questions his work will seek to answer are the following: What is the relation between the juridical form of property and the underlying social structures of appropriation it codifies? How do digital property regimes challenge or reproduce the traditional institutional function of ownership as a form of power and exclusion? What normative principles could guide the formulation of legal rights in digital societies, especially when the object of property is shared social knowledge rather than physical goods?
